What is a binding ruling request?

A binding ruling request is a formal inquiry submitted by an importer or exporter to U.S. Customs and Border Protection (CBP) seeking official guidance on how specific goods will be treated in terms of classification, valuation, origin, marking, labeling, or application of the United States-Mexico-Canada Agreement (USMCA) and other trade programs.  In response to these requests, CBP provides legally binding rulings that apply to the requesting party and to the specific goods and circumstances described in the ruling request.  Decisions are only binding on the party that requests them, but they can be persuasive in unrelated matters.  Binding rulings set case precedent and therefore help ensure consistency and predictability in the assessment of goods during import or export.  These rulings are crucial for businesses in need of guidance on how CBP will view their goods, allowing them to make informed decisions, manage risks, and streamline their international trade processes.
